About These Terms
These terms apply to your use of the Notey app. By using the app you agree to them. If you don't agree, please don't use the app. If you got the app from the App Store, these terms apply alongside Apple's Licensed Application End User License Agreement. Where the two conflict, these terms apply to the extent the law allows.
Recording Laws
Many places require the consent of everyone being recorded, especially on phone calls. Some require everyone on a call to agree. You are responsible for knowing and following the recording, privacy and consent laws that apply to you and to the people you record. Don't use the app to record anyone unlawfully.
Transcripts and Summaries
Transcripts, titles and summaries are made automatically by speech recognition and language models on your device. They may be incomplete or wrong, and may contain things that weren't said. Check them against the recording before relying on them, and don't rely on them alone for medical, legal, financial or other important decisions.
Your Recordings
Your recordings, transcripts and summaries belong to you. They are stored only on your device and are not uploaded to us. You are responsible for keeping copies of anything you want to keep: deleting the app or resetting your device can delete them, and we can't recover them.
Third-Party Software and Hardware
The app uses open-source software and machine-learning models from other authors, each under its own license, listed under Licenses in Settings in the app. The app works with recorders made by others. We don't make the recorders and aren't responsible for them.
No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE APP WILL WORK WITHOUT INTERRUPTION OR ERRORS, THAT RECORDINGS WILL BE CAPTURED OR TRANSFERRED WITHOUT LOSS, OR THAT TRANSCRIPTS AND SUMMARIES WILL BE ACCURATE.
Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, RECORDINGS, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR IT, IF ANY. Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms limits rights you have under consumer law that can't be waived.
Changes
We may update these terms. The date at the top shows when they last changed. Continuing to use the app after a change means you accept the updated terms.
